Licence to plant within the highway
This licence provides a service that allows you to enter into the highway for the purpose of planting.
Without this process Lincolnshire County Council would be unable to ensure the nature and type of plant being placed within the highway and the safety of the public
Who is it available to?
You will be granted permission to enter into the public highway providing that details are provided in accordance with the requirements of the Highways Act 1980 Sections 141 and 142:
- An accurate location plan providing the details of the proposed plants and extent of works within the public highway.
- Evidence of valid Public Liability Insurance to a minimum of five million pounds.
- Proposed start of works date.
- Name, address and signature of the Applicant.

Further Information
Once you make an application it will be checked to make sure all the necessary documentation is enclosed and the relevant sections have been completed correctly. You will be contacted to supply any outstanding information if anything has been omitted.
Observations
The details of your request will be assessed for issues/conflicts. Any conditions to be adhered to during your works will be added to your application. On occasion, it may be necessary to contact you to discuss your works further and attempt to resolve any outstanding issues.
Signing of Licence
Three copies of the private licence will be sent to you for signing. All three copies must be signed by you and witnessed before returning.
Issue of Licence
It is in the public interest that the authority must process your application before it can be granted. If you've not heard from Lincolnshire County Council within a reasonable period, please contact us using the correct details below:

When the licences have been returned they will be countersigned and documentation, together with any conditions of work, will be processed and issued to you, within 1 month. You may now proceed with your works as agreed.
Licence
If it is not possible to resolve any outstanding issues/conflict, your application will be refused. You will be unable to carry out your proposed works and your paperwork will be returned to you.
No works are to commence until licence is issued.
