The Council determined not to make a modification order on the grounds that rights of way for mechanically propelled vehicles were extinguished under the Natural Environment and Rural Communities Act 2006 and that the Application does not meet any of the exceptions set out in that Act.
The public right of way for non-mechanically propelled vehicles remains intact, which is consistent with the current classification of the route as a restricted byway.
