Decision made to make a definitive map modification order (DMMO) to amend the legal record of public rights of way from public bridleway to restricted byway. The decision is made on the grounds that the documentary evidence is sufficient, on the balance of probability, to demonstrate that a higher status of right of way exists than that currently recorded on the Definitive Map and Statement.
The public rights of way for mechanically propelled vehicles were extinguished under the Natural Environment and Rural Communities Act 2006 and the Application does not meet any of the exceptions set out in that Act.
The public right of way for non-mechanically propelled vehicles remains intact, warranting the making of a DMMO for a restricted byway.
