There are four decisions for this Application:
1. Decision made not to make a definitive map modification order (DMMO) to amend the legal record of public rights of way from public bridleway to byway open to all traffic. The decision is made on the grounds that public rights of way for mechanically propelled vehicles were extinguished under the Natural Environment and Rural Communities Act 2006 and the Application does not meet any of the exceptions set out in that Act. Although a right of way for non-mechanically propelled vehicles remains, the evidence regarding the precise alignment of the route is conflicting, and therefore insufficient to demonstrate that the public bridleway should be upgraded to a restricted byway.
2. Decision made to make a DMMO to add to the legal record of public rights of way a public bridleway between Public Bridleway No. 9 and Keisby Road. The decision is made on the grounds that the documentary evidence is sufficient to reasonably allege that the public bridleway should be extended to meet the highway known as Keisby Road.
3. Decision made to make a DMMO to add to the legal record of public rights of way a restricted byway between Restricted Byway No.12 and Public Bridleway No. 9. The decision is made on the grounds that the documentary evidence is sufficient to reasonably allege that a restricted byway exists between these points.
4. Decision made to make a DMMO to amend the legal record of public rights of way from public bridleway to restricted byway for the north-eastern section of Public Bridleway No. 9. The decision is made on the grounds that the documentary evidence is sufficient, on the balance of probability, to demonstrate that a higher status of right of way exists than that recorded in the Definitive Map and Statement. The rights of way for mechanically propelled vehicles were extinguished under the Natural Environment and Rural Communities Act 2006 and the Application does not meet any of the exceptions set out in that Act. The public right of way for non-mechanically propelled vehicles remains intact, warranting the making of a DMMO for a restricted byway.
