Decision made to make a definitive map modification order (DMMO) to add to the legal record of public rights of way a restricted byway between Public Bridleway No. 9 and Hawthorpe/Elsthorpe Road. The decision is made on the grounds that the documentary evidence is sufficient to reasonably allege that a byway open to all traffic exists. The rights of way for mechanically propelled vehicles were extinguished under the Natural Environment and Rural Communities Act 2006 and the Application does not meet any of the exceptions set out in that Act. The public right of way for non-mechanically propelled vehicles remains intact, warranting the making of a DMMO for a restricted byway
