Objections were lodged against the making of the Definitive Map Modification Order (DMMO). As a result, the Order was submitted to the Planning Inspectorate for an Inspector’s decision based on the evidence on whether it should be confirmed.
Following a public inquiry held in September 2023, the Inspector determined to confirm the Order with modifications. The proposed modifications centre on amending the Order to record the route as a 1.5-metre-wide public footpath instead of to a 2-metre-wide restricted byway for which the Order was originally made. The proposed amendments were subject to a 4-week public consultation carried out by the Planning Inspectorate which ended on 28 March 2024.
A number of representations or objections were lodged in respect of the amendments that the Inspector is proposing to make to the Order. The Inspector is considering the objections to the amendments that are being proposed to be made to the Order by written representations with the affected and interested parties. This process is scheduled to end on 15 October 2025 after which the Inspector will make a final decision based on the evidence on whether the Order should be confirmed with or without amendments proposed or not confirmed. The route would only be recorded as a public right of way should the Order be confirmed with or without the amendments proposed.
