The Council determined not to make a modification order on the grounds that the towing path was subject to statutory rights connected with the navigation rather than general public right of passage. There is no evidence that public footpath rights were dedicated, preserved or otherwise established over the towing path. In addition, although the 1796 Inclosure Award provided for the continuation of existing public footpaths over old inclosures, there is no evidence to substantiate the existence or alignment of any public footpaths in this case.
