This is in relation to ELDC planning application reference: N/052/02126/21

1. Were LCC highways consulted by East Lindsey District Council ELDC, in respect to a planning application N/052/02126/21 Land at the rear of style furniture, main road, Fotherby , Louth, Lincolnshire, LN11 0TD.

2. How did LCC Highways come to their conclusion, i.e. , did they perform a site survey, or just on the information provided by ELDC.

3. In what form was the request made by ELDC.

4. What evidence, consultations did ELDC submit too LCC highways and planning.

5. How did LCC highways and planning, after the consultation period arrive at their decision of "raise no concerns"

6. I would like copies of the case officers reports/findings/conclusions and what written evidence ELDC provided you with.

7. If new information or information that LCC are not or have not been made aware of is brought to your attention, should the case officer from LCC Highways revisit/reinvestigate his/her decision of "no concerns"? In fact are LCC not obliged to revisit the site and it's original decision?

8. Do you LCC highways not have a duty of care to the members of the public, to ensure that every care has been taken to protect their safety.

9. If an accident or fatality does occur on this access track because LCC highways failed to listen to the warnings and look again at their decision of, "no concerns" can anyone at LCC be then held responsible.

 

Decision

I can confirm that the information requested is held by Lincolnshire County Council. I have detailed below the information that is being released to you.

Lincolnshire County Council, as Highway and Lead Local Flood Authority, were consulted by East Lindsey District Council on planning application reference N/052/02126/21 on 15th October 2021. Attached is a copy of the consultation letter.

LCC made our assessment based on the information available on East Lindsey District Council’s online planning portal for this application, a desktop assessment of the proposals, and an inperson on-site assessment of the proposals.

An interim response was sent to East Lindsey District Council on 8th November 2021, requesting further information in relation to the proposed access .

Our final response to the planning consultation was sent on 8th April 2022. I attach copies of both responses.

We will respond to any consultations from East Lindsey District Council, as Local Planning Authority, on amendments to the planning application. Lincolnshire County Council as Highway Authority assess all planning applications in accordance with national legislation and guidance applicable at the time, with regard to highway safety.
