1. Please could I ask you to provide all previous DMMO applications (both approved and not approved for a Modification order) that have been made by applicants (members of the public or by organisations etc.) in the past in the areas of 'Lissington', 'Holton cum Beckering', 'Well' and 'Alford' to Lincolnshire County Council.

1. Please find below information relating to all Definitive Map Modification Order (DMMO) applications past and current which have been made for routes in the parishes of Alford, Holton cum Beckering, Lissington, and Well.  Copies of some of the applications requested can be viewed at https://www.lincolnshire.gov.uk/directory/8/register-of-dmmo-applications.

Claimed BOAT between Lissingley Lane and Linwood Road.

A Modification was made in 1995 to record the route as a byway open to all traffic (BOAT), and it was confirmed as unopposed in 1997

Holton cum Beckering

08.12.1990

Claimed BOAT along Watery Lane.

A Modification Order was made and confirmed in 2002 to record the route as a public bridleway.  However, However, the Order just referred to the Definitive Map and Statement for the area of the former Welton Rural District.  This means that it only recorded that part of Watery Lane in Holton Cum Beckering as a public bridleway, as it lay within the area of the former Welton Rural District.  The remainder of the route in Lissington is not recorded as a public bridleway because the Modification Order did not amend the Definitive Map for that area, namely the Definitive Map and Statement for the area of the former Caistor Rural District.  DMMO application 303 seeks to record a BOAT over Watery Lane, so the existence of a public right of way over that part of Watery Lane in Lissington will be investigate as and when this application is commenced in line with the Modification Order Priority Schedule.

Decision taken to make a modification order, but the case remains in abeyance until officer time becomes available to progress the case in line with the Modification Order Priority Schedule.

Claimed BOAT between Hanby Lane and New Alford Cemetery.

A Modification Order made in 2015 to record the route as a public footpath, and it was confirmed by the Secretary of State in 2016.

The application can be viewed at Register of DMMO applications – Lincolnshire County Council.  A copy of the Order and decision by the Secretary of State is attached as “DMMO 334 Alford documents”.
