1. I would like from Highways under public disclose to identify what waste and carrying licences where held both for removal and depositing this waste via the two authorities and what risk assessment for utilising the narrow road surface via Highways and North Kesteven Authority was submitted or considered?
2. Who will repair this as it creates significant danger to any one attempting to pass this section?
3. If there are not the appropriate licences can I be informed prosecution or cost to make remedial repair are acted upon? - Decision

1. Lincolnshire County Council (LCC) Waste Operations team do not hold this information. The permits and licences referred to are likely issued by the Environment Agency and details could of course be gained from the contractor directly. This operation is not something that LCC waste team nor our highways team have been involved with. It cannot speak for the planning authority.
2. Any significant damage to the highway, whatever the cause, is likely to be repaired by the Highway Authority as and when required, under the guidance of its inspection and intervention policy. If there is proof that this damage has been caused by individuals or companies, then the Highway Authority will seek to recover the costs from those involved.
3. The Environment Agency would prosecute if there were breaches to formal agreements under licensing or disposing of materials, or if there were no agreements in place at all and they felt there were breaches in law.
