1. Can you please supply a full hierarchical staff structure of those staff members who form the Water & Flood management team within LCC together with their role and Contact e mail. This to include line report structure to executive/Councilor level.

2. As part of the Councils PFR grant scheme, Whitehouse Construction were appointed to carry out surveys and remedial works. Please Provide details of the Tender Process carried out to achieve this appointment.

a) Was the Tender carried out in accordance with the Applicable Public Procurement Directive. Please supply Tender Reference.

b) How many bids were received?

c) How many staff who managed this process hold The MCIPS or FCIPS qualification?

d) What was the expected value of this Contract and what is the actual Contract value?

e) What was the value gap in £'s between the successful and second bidder?

Decision

I can confirm that the information requested is held by Lincolnshire County Council. I have detailed below the information that is being released to you.

1. Attached is the structure chart for the Floods and Water Team at Lincolnshire County Council including roles. Names and direct email addresses have not been supplied as this is personal information and therefore exempt. Details of Executive Councillor details are available on the Lincolnshire County Council website.

2a). Whitehouse Construction were procured using the Environment Agency’s (EA) 2024 Property Flood Resilience (PFR) framework. This is the primary approved route to market for any PFR activities that fall within the Frameworks defined Scope of Services thus ensuring services and works provided are done so in line with the PFR Code of Practice. This framework is open to Local Authorities in England and Wales and allows direct award to the primary delivery partners for each of the National Hubs. Whitehouse Construction is the primary delivery partner for the Midlands Hub.

b) This was a direct award using the EA PFR Framework as per the above.

c) Lincolnshire County Council does not hold this information.

d) The expected value of this contract was £840,000. The contract is still live and the work with Whitehouse Construction is not yet finished, so the actual contract value is not yet available. e) As per the above, this was a direct award through the EA PFR Framework.

3.a) Through the provision of information, the following Risk Management Authorities assisted with the above investigation: Environment Agency, Severn Trent Water, Trent Valley Internal Drainage Board, and North Kesteven District Council.

b) This is personal information and therefore exempt.

This personal information is exempt from disclosure under section 40(2) which, by virtue of section 40(3)(a)(i), allows a public authority to withhold information from a response to a request under the Freedom of Information Act when the information requested is personal data relating to someone other than the requestor, and its disclosure would contravene one of the Data Protection principles. We consider that none of the individuals referred to in this information would anticipate or expect such details to be disclosed into the public domain. Therefore, we consider that such a disclosure would be unfair and in breach of the first Data Protection principle which states that “Personal data shall be processed fairly and lawfully …” It is for this reason that it is being withheld you in reliance on section 40(2) of the Freedom of Information Act.

c) With respect to how many meetings were held, during the evidence gathering phase of the investigation a total of four meetings were held as far as the Floods and Water team are aware dated 11/01/2024, 23/01/2024, 22/02/2024, and 21/03/2024.

d) Senior Flood Risk Officers from the Floods and Water Team represented Lincolnshire County Council at these meetings
