Q1.) How many complaints related to Japanese Knotweed in domestic gardens did the council receive in the following years; 2024, 2023, 2022, 2021 and 2020.

Q2.) Of the above complaints relating to Japanese knotweed in domestic gardens, how many of the following actions were taken in 2024, 2023, 2022, 2021 and 2020.

a)     Section 80; Abatement Notice under the Environmental Protection 1990 and under which subsection of section79.

b)     Community Protection Notice under the Anti-Social Behaviour, Crime and Policing Act 2014

Q3) Please provide a link or attachment of any policy or procedure related to Japanese knotweed complaints the local authority utilises when handling complaints on the invasive plant.

Decision

I can confirm that the information requested is held by Lincolnshire County Council. I have detailed below the information that is being released to you.  
 
 Q1.) The presence of noxious weeds in domestic gardens, in and of itself, is not a concern for the highway authority. However, should those noxious weeds be found to migrate onto areas that are highway from domestic gardens then the Highway Authority have powers to take action against the offending private landowners. This team is not aware of any cases where such action has been taken.
