Pothole Environmental Information

1) please provide copies of all environmental information you hold relating to my pothole claim (Reference UNM/REZ011.9153) on Stainton Lane, Scothern, Lincoln (opposite entrance to Scothern Grange Farm) originally submitted on 7 December 2023.

Specifically, I request:

a). All site inspection reports, risk-assessment records, defect registers or internal notes concerning this defect.

b). Any photographs, videos or other visual records of the defect.

c). All internal correspondence and emails discussing the decision to refuse my claim.

a. – Please see attached document.

b. - No – We don’t have any photos of the defect.

c. This information is refused in accordance with Section 40 Personal information and Section 42 Legal Professional Privilege (LPP), of the Freedom of information Act (FOIA)
We have determined that the information which is applicable to this question is information which contains your personal data and correspondence between the Council (Client) and Legal Advisor.
Personal data is exempt from disclosure under the FOIA. A request to see how the Council processes your personal data and request a copy can be requested by making a Subject Access request.
Correspondence created for the purpose of defending a legal claim is subject to LPP. Any information created in respect of a claim to LPP is exempt information. This allows the client to speak freely with their legal advisor with the expectation that communication between them is confidential and will promote fairness in legal proceedings. LPP can also apply to a Subject Access request
