Seizures Involving illegal or non-compliant vaping products

Request

Please provide data for the period 1 January 2024 to 31 December 2024. If possible, please break the data down by quarter or year. Specifically, I request:


1) The number of seizures involving illegal or non-compliant vaping products.

2) The number of fixed penalty notices, formal warnings, enforcement notices, cautions, or other actions issued to vape retailers.

3) The reasons for non-compliance. If possible, please supply this information in a spreadsheet or machine-readable format, with each data point clearly identified under the above headings.

4) If you do not hold all the information requested, please provide any partial data you have and indicate which elements are missing.

Decision

 

  1. 16,826 Vapes consisting on 63 seizures from 51 Premises

 

  1. No Fixed Penalty Notices issued

 

  • Formal warning/enforcement notices in the form of a Trading Standards Report (TSR) would be issued at every premise where a seizure is made. 
  • 70 closure orders issued to 57 premises in 2024
  • 10 prosecutions concluded in 2024 – note prosecutions can take longer than a year to reach conclusion, therefore prosecutions may relate to seizures prior to 2024. 

 

  1. In the main seizures were a result of the nicotine strength of the vape or the tank size exceeding what is permissible within the Tobacco and Related Product Regulations 2016 

 

Some seizures were made following the underage sale of a vape, contrary to The Nicotine Inhaling Products (Age of Sale and Proxy Purchasing) Regulations 2015
