Recovering Costs to the Public Purse

Request

1. In your capacity of Head of Finance I would be grateful if you could provide me with a copy of the council policy on recovering costs to the public purse resulting from damage to public infrastructure.

For example, where a motorist collides with a traffic bollard, or an agricultural contractor destroys a streetlight whilst cutting a hedge, does the council pursue the individual (or company), or their insurer to recover costs incurred in replacing the damaged installation?

2. If the council policy is not to recover such costs, please can you provide an explanation why?

Decision

I have detailed below the information that is being released to you.

The Council’s approach, which aligns with our value for money principles, is to always recover costs associated with damage to council owned infrastructure, where there is a party to recover from.
