Tuition services for children funded by the council

Please provide the following information regarding tuition services for children funded by the council:

1. What is the hourly pay rate for tutors providing home tuition or alternative provision to children funded by the council?

2. Is this rate based on the School Teachers' Pay and Conditions Document (STPCD), National Joint Council (NJC) pay scales, or another pay structure? Please specify which scale/point.

3. If the council uses agency providers to supply tutors, what hourly rate should those agency tutors be paid after 12 weeks under the Agency Workers Regulations 2010?

4. Does the council have written policies requiring agency providers to comply with the Agency Workers Regulations 2010 regarding equal pay after 12 weeks?

I do not require any information about specific students, staff members, or agencies. I am only seeking information about pay rates and policies.

Decision

1. Pilgrim HT is paid at £45 per hour. The hourly rate paid by Pilgrim is £34.47, increasing to £48.84 including on-costs.

 

2. This rate is based on the School Teachers' Pay and Conditions Document (STPCD).

 

3. Lincolnshire County Council do not hold this information as maintained schools are responsible for their own recruitment.

 

4. Please see below an extract from the ‘Agency and other off payroll guidance’, which discusses equal treatment after 12 weeks:

 

AGENCY WORKER REGULATIONS 2010

 

From the first day of an assignment all agency workers will be given the same access

 

to the organisation’s collective facilities and amenities as a comparable worker who is

 

recruited directly. Agency workers will have access, for example, to:

 

  • Staff rooms and toilet and shower facilities
  • Information about any relevant internal job vacancies within the organisation
  • and to have the opportunity to apply for these vacancies.

 

After 12 weeks on assignment within the school, the agency worker is entitled to

 

equal treatment i.e. the same basic employment and working conditions as an

 

employee who has been directly recruited to the same job. This includes:

 

  • Basic pay (including, where appropriate additional risk payments for hazardous duties /overtime pay /unsocial-hours allowance /shift allowance)
  • Pro-rata annual leave
  • Paid time off for antenatal appointments
  • Working hours
  • Rest periods

 

 

The right to equal pay does not include:

 

  • Occupational sick pay,
  • Occupational pensions,
  • Maternity, paternity or adoption pay (the Regulations do not affect an agency worker’s statutory entitlements), Redundancy pay (statutory or contractual),
  • The right to participate in salary-sacrifice schemes such as childcare vouchers.
