Section 21 Freedom of Information Act (FOI) – Information accessible to applicant by other means.

We have determined that we are not required to disclose this information. Our Section 38 process in accordance with the Highways Act 1980 requires that we submit this information into the Land Charges register. The register is a public record which shows charges on land or property. When we notify HM Land Registry of the charge, we provide to them the bond value and a copy of the design which shows the designer’s name.

Section 21(1) of the Freedom of Information Act states “information which is reasonably accessible to the applicant otherwise than under S1 FOIA is exempt information”. Section 21 (2)(a) states “information may be reasonably accessible to the applicant even though it is accessible only on payment”.
