I have been tasked by the business to review a number of historic planning permissions / developments which we have subsequently completed to review whether relevant s106 financial contributions have been spent or whether any monies are due to be returned.
1) As such are you able to confirm whether the financial contributions secured through the above planning permission / associated legal agreement (attached) have indeed been spent or whether they are now due for return? - Decision

1. The S106 agreement dated 25th October 2006 relates to planning application reference 2004/0587/O, for the erection of dwellings, with access to Newark Road, and alterations to existing sports facilities. The completed residential development is known as Pavillion Gardens. Clause 1 of the Second Schedule states that the sum is to be utilised by the Education Authority towards the provision of education facilities required by virtue of the development. The contribution to Education was paid by the developer and has been spent in full, in accordance with the terms of the agreement, on projects at Sir Robert Pattinson Academy and North Kesteven Academy. It is not possible to provide further details because the spend took place over 10 years ago. For information in respect of Clause 3, please contact the Local Planning Authority.
