Several elements of my original request concern environmental information as defined by Regulation 2(1) of the Environmental Information Regulations 2004. This includes information on the state of water, soil, and land; factors affecting or likely to affect these elements (such as drainage infrastructure and construction activities); and measures or activities affecting or designed to protect them.
The EIR provides a distinct legal framework with a presumption in favour of disclosure and a broader definition of information held (including information held on behalf of the authority). I therefore make the following requests expressly under the EIR:
1. Drainage Infrastructure and Defects
1a. All information held by the council regarding the drainage system serving this development, including inspection reports, test results, assessments, site visit notes, photographs, and any technical evaluations.
1b. All information held regarding reported or identified drainage defects, incorrectly installed drainage, misconnections, or unresolved drainage issues affecting the development or individual properties within it.
1c. All information held regarding the Section 104 agreement (or proposed agreement) between the developer and Severn Trent Water, including any correspondence in which the council has been consulted or copied.
1d. All information regarding the council's responsibilities for highway gullies and lateral pipework at this site, including any assessments of their condition or fitness for adoption.
2. Flooding and Surface Water
2a. All information held regarding flooding, surface water drainage problems, or water logging at or caused by this development.
2b. Any flood risk assessments, surface water management plans, or sustainable drainage (SuDS) assessments submitted or held in connection with the development.
2c. Any reports of flooding or drainage complaints received from residents of the development or neighbouring properties.
3. Environmental Health and Site Condition
3a. All information held regarding the environmental condition of the unfinished development site, including waste, debris, contamination, or any hazard to human health or the environment.
3b. Any risk assessments, environmental assessments, or inspection reports relating to the incomplete state of the development.
4. Measures and Decision-Making
4a. All correspondence, reports, and internal communications regarding any measures taken or proposed by the council in relation to the environmental issues identified above.
4b. Any communications with the developer, Severn Trent Water, the Environment Agency, or any other body regarding drainage, flooding, or environmental matters at this site. - Decision

In addition to the original answer, Outside of the Technically approved drawings, Appendix A2 - A16, no signed S38 agreement, no inspection records are held.
1b. All information held regarding reported or identified drainage defects, incorrectly installed drainage, misconnections, or unresolved drainage issues affecting the development or individual properties within it.
As the S38 agreement had not been signed by the Developer, LCC Inspections would not take place. Informal direction with regards to specification can be given by LCC Inspectors at their discretion to the developers.
1c. All information held regarding the Section 104 agreement (or proposed agreement) between the developer and Severn Trent Water, including any correspondence in which the council has been consulted or copied.
Appendix D1 confirms correspondence between the Developer and Severn Trent Water.
1d. All information regarding the council's responsibilities for highway gullies and lateral pipework at this site, including any assessments of their condition or fitness for adoption.
