1) Do LCC or LCC Highways owns the drainage ditches along Main Road, Long Bennington from the development site identified in SKDC planning application S24/2214 to the Ease Drain to the south.

2) If you confirm ownership, please add reference to who is responsible for the maintenance of these dykes.

1) We have checked with our Legal Services Team and the ditches heading South from The Pastures (What3Words ///plants.patio.variances) to just before the roundabout is unregistered land. Therefore there is no registered owner of the ditches and we can confirm that LCC are not liable for these ditches. The ditches from the roundabout heading south along Marshall Way (What3Words ///instilled.herring.listed) are not owned by LCC and are the landowner’s responsibility and we would advise that you contact the Land Registry to obtain these details.

2) With regards to the ditches that are unregistered LCC are not liable for the maintenance of these, however should it be found that they are causing safety issues or damage to our assets then we may carry out work without prejudice. With regards to the ditches from the roundabout heading South along Mashall Way as previously mentioned these are the responsibility of the landowner to maintain and we would advise that you contact the Land Registry to obtain these details.
