3. From our automated system Reason for cancelling: We write to inform you that the application to suspend the parking bays intended for use as a pavement café area has been refused. In light of this refusal, and having regard to the existence of a long-standing market charter affecting the area, we regret to advise that the current pavement café licence is hereby revoked with immediate effect. This decision has been taken to ensure the safety of members of the public using the area, as well as the safety of road users. Should you wish to submit a new application, you are advised to first consult with Boston Borough Council regarding the suspension of the relevant bays. If the Council supports such a suspension, you may then submit a further application for bay suspension, accompanied by appropriate supporting evidence. Following this, a new pavement café licence application may be submitted. You are also advised to consult the Boston Borough Market Manager and discuss arrangements and potential impacts the Boston market may have. In the event you come to a new seating arrangement that does not require a bay suspension we welcome an application with all the supporting documents as necessary. Please note that any Pavement Café Licence application will be considered on its own merits, and previous decisions will not be taken into account. No furniture is to be placed on the public highway unless a valid licence has been issued. Any furniture found on the public highway without a valid licence may result in enforcement and removal of the furniture.

5. Pavement café licensing in the UK is governed by the Business and Planning Act 2020, as permanently amended by the Levelling Up and Regeneration Act 2023.

We do not usually suspend bays for a cafe licence and they want the suspension for a year - previously this was done under pandemic legislation which no longer exists but this is income BBC are losing out on with the P&D bays being out of action.

A new process will need to be put in place for applications like this so that the bay suspension and licence dates align. Confirmed with LCC Staff the earliest date will be the 24 October 2023 so he will make sure the licence start date aligns with this.
Agreed this is a Free of charge suspension as they have provided road closures for another business free of charge.
