1) I would like to request information regarding which documents have been reviewed when considering Lenton, Keisby and Osgodby and Irnham DMMO 295 

2) would like to request to receive copies of the documents that have been reviewed, please can you provide the relevant information and advise regarding copies/viewing the documents?

3) Could you also advise regarding the objections/appeals procedure please?

Decision

1-3) Please find attached the documentary evidence on which the Council based its decision to make a Modification Order, together with a copy of that decision.

The next stage in the process is for the Council to make the Modification Order. Once made, the Order will be subject to a six-week statutory consultation period.

This will include serving a copy of the Order and notice of its making on the relevant parish councils, statutory undertakers, user groups, affected landowners and occupiers, and other interested parties. Notices will also be published in a local newspaper and displayed at each end of the route affected by the Order. During the consultation period, anyone may make representations in support of, or object to, the Order. However, for an objection to be considered relevant, it must relate to the evidence in support of the existence of a public right of way.

This is because the Order is made through an evidence-based statutory process to determine whether public rights exist along the route. Matters such as the desirability of the route, the need for a public right of way, or the effect that recording a right of way may have on the land cannot be legally taken into account as part of this process.
