Flood and Water Management Act Recommendation Implementation - Find a freedom of information request

For every S19 report your authority has filed as part of its 'lead local flood risk management authority' duties under the 2010 Flood and Water Management Act, I would like to request information about whether the recommendations have been implemented and when.

I can confirm that the information requested is held by Lincolnshire County Council. I have detailed below the information that is being released to you. 

It should be noted that it is not a requirement under the Flood and Water Management Act 2010 to make recommendations as part of a Section 19 Investigation. Making recommendations is an additional measure that Lincolnshire County Council has decided to undertake and report against under the Lincolnshire Flood & Water Management Partnership Framework.

Under the Flood and Water Management Act 2010 the purpose of investigations is to determine:

• which risk management authorities have relevant flood risk management functions
• whether each of those has exercised, or is proposing to exercise, those functions in response to a flood event
• Some of the recommended actions identified in section 19 reports are for other agencies and individuals. The council can only update on the progress of its’ own actions and that of partners where they have let us know.

The reports do not blame or hold any authority or individual to account nor does it give powers for Lincolnshire County Council in its role as Lead Local Flood Authority to legally enforce any recommendations made.

The information requested however, is made publicly available via the Lincolnshire County Council website at https://www.lincolnshire.gov.uk/flood-risk-management/flood-investigations It should be noted however, that at the time of writing the system is currently being upgraded and only the recommendations from investigations undertaken post October 2023 are currently available. Once the system has been updated all investigations dating back to 2012 will be available to search online via the above link and this is expected to be completed in early 2025.
